General Terms and Conditions (AGB) for SDH Reinigung und Service

§1 Scope of Application

1. These General Terms and Conditions apply to all services provided by SDH Reinigung und Service.

2. Deviating conditions from the customer will not be accepted unless expressly confirmed in writing by SDH Reinigung und Service.

§2 Conclusion of Contract

1. The contract is concluded when the customer confirms the offer from SDH Reinigung und Service in writing.

2. Verbal agreements must be confirmed in writing to be valid.

§3 Scope of Services

1. The scope of cleaning services is determined by the agreement between the parties.

2. Changes or additions to the scope of services must be agreed upon in writing.

§4 Prices and Payment Terms

1. All prices are exclusive of VAT unless expressly stated otherwise.

2. Invoices must be paid within 14 days of receipt without deduction.

3. In case of late payment, SDH Reinigung und Service reserves the right to charge statutory interest on arrears.

§5 Service Timing and Delays

1. Agreed dates and deadlines are binding if confirmed in writing.

2. SDH Reinigung und Service is exempted from its service obligations in cases of force majeure or other unforeseen events that significantly hinder or render the service impossible.

§6 Liability

1. SDH Reinigung und Service is liable for damages only in cases of intent or gross negligence.

2. In cases of simple negligence, liability is limited to foreseeable damages resulting from the breach of essential contractual obligations.

3. Any further liability is excluded.

§7 Warranty

1. Complaints must be reported to SDH Reinigung und Service immediately, but no later than 24 hours after service completion, in writing.

2. SDH Reinigung und Service reserves the right to rectify issues at its discretion.

§8 Data Protection

1. SDH Reinigung und Service commits to handling personal data of the customer in accordance with applicable data protection regulations.

2. Data will only be shared with third parties if necessary for contract execution or if the customer explicitly consents.

§9 Termination

1. Termination of the contract must be in writing.

2. In case of immediate termination for a compelling reason, the right to claim damages remains unaffected.

§10 Final Provisions

1. The laws of the Federal Republic of Germany apply.

2. The place of jurisdiction for all disputes arising from this contract is the headquarters of SDH Reinigung und Service, provided the customer is a merchant.

3. If any provision of these General Terms and Conditions is invalid or becomes invalid, the validity of the remaining provisions shall remain unaffected.
